Mumbai: The Maharashtra Real Estate Regulatory Authority (MahaRERA) has issued a directive to developers, mandating them to clearly include the details of parking spaces allotted or sold to homebuyers in the sale agreements and allotment letters. The move aims to protect homebuyers and prevent potential disputes over parking allocation.

In the recent announcement, MahaRERA emphasized the importance of transparency and instructed developers to include comprehensive details regarding parking spaces, including the number, dimensions (length, height, and width), and the exact location of each parking slot. The new directive is intended to eliminate any ambiguity and avoid future conflicts between homebuyers and developers.

This decision follows multiple complaints from homebuyers regarding issues such as insufficient parking space, building beams obstructing parking areas, difficulties in parking in the designated slots, and limited maneuvering space. These challenges have caused significant inconvenience for homeowners who expected parking facilities that met their requirements.

To facilitate compliance, MahaRERA has provided a model draft clause that developers must incorporate into their legal documents. The regulator has stressed that adherence to these new requirements is mandatory and aims to prevent future grievances once homebuyers occupy their homes.

“We aim to eliminate any potential ambiguity or disputes that may arise later by certifying these clauses,” stated MahaRERA. The regulator has also encouraged homebuyers to lodge complaints with their office if they face any discrepancies regarding parking space allocation.

This initiative follows a notable case in Pune where a homebuyer reported that the mechanical parking space allotted to him was smaller than promised, rendering it unusable for his SUV. MahaRERA intervened and instructed the developer to resolve the issue within a month.
